Terms

• There will be a $50.00 charge on your account for each returned check.
• Payments not made according to given terms shall be subject but not limited to 1½% monthly interest.
• Merchandise purchased with tax exemption will be solely for resale purposes.
• In consideration of purchasing products from Pitco Foods, the undersigned agrees to pay any and all debts on demand or within terms.
• Furthermore, the undersigned hereby gives a continuing individual and personal guarantee and promise to pay creditor all sums due on demand.
• In the event Pitco Foods must refer this agreement to an attorney or any outside agency for collections, any and all fees accrued will be the responsibility of the applicant.
• In the event that Pitco Foods assigns the applicant’s delinquent debt to a debt collector, the applicant may, by written request, obtain a statement of the following categories of information (subject to certain limitations):
  • The debt collector has authority to assert the rights of Pitco Foods to collect the debt.
  • The debt balance and an explanation of the amount, nature, and reason for all interest and fees, if any, imposed by Pitco Foods or any subsequent entities to which the debt was assigned. This includes:
    • The balance
    • The total of any interest
    • The total of any fees
  • The date the debt became delinquent or the date of the last payment.
  • The name and address of Pitco Foods and its account number associated with the debt.
  • The name and last known address of the applicant as they appeared in Pitco Foods’ records before the assignment of the debt to the collector.
  • The names and addresses of all persons or entities (other than the debt collector) to which the debt was assigned.
  • The California license number of the debt collector, if applicable.
• The applicant must notify Pitco Foods and/or creditor of any change in the applicant’s name, address, or employment within thirty (30) days of such a change.
• In connection with any covered credit extended under an account, the applicant shall not attempt to consummate any transaction knowing that credit privileges under such account have been terminated or suspended.
• The applicant must notify Pitco Foods and/or creditor by telephone, letter, or other reasonable means of any unauthorized use of the account as a result of loss or theft of a credit card or other instrument identifying the account within thirty (30) days after discovery, and shall reasonably assist Pitco Foods and/or creditor in determining the facts and circumstances of such unauthorized use.

The undersigned hereby consent(s) to the use of a non-business consumer credit report by (name of creditor) in order to evaluate the creditworthiness of the undersigned as principal(s), proprietor(s), and/or guarantor(s) in connection with the extension of business credit contemplated by this credit application. The undersigned also authorizes Pitco Foods to obtain a consumer credit report from time to time as needed in connection with the extension or continuation of the business credit represented by this credit application. The undersigned, as individual(s), knowingly consent(s) to the use of such a report in accordance with the Federal Credit Reporting Act.
